Maine's Paid Family and Medical Leave (PFML) program is now active: payroll contributions began January 1, 2025, and eligible employees became able to draw benefits starting May 1, 2026 — up to 12 weeks of partially paid leave within a 12-month period for medical, parental, family care, or safe leave reasons. Employers with fewer than 15 employees are exempt from the employer share of the contribution but must still collect and remit the employee share. Separately, Maine's Earned Paid Leave law requires employers with more than 10 employees to provide up to 40 hours of paid leave per year, usable for any purpose.
Maine is one of only two states in the country — along with New Jersey — that requires mandatory severance pay for certain layoffs, independent of federal WARN Act notice obligations. Under 26 M.R.S. §625-B, an employer with 100 or more employees that closes, relocates, or conducts a qualifying mass layoff at a covered facility must pay eligible employees severance of one week's pay for each year of service, in addition to final wages, within one pay period after the employee's last day.
